Understanding the Current Situation

Wisconsin law requires proof of legal residence to obtain a driver’s license. This requirement stems from a 2007 federal law that prohibited states from issuing driver’s licenses to undocumented immigrants unless states specifically passed legislation allowing it. While 19 states have enacted such legislation, Wisconsin has not yet done so.

According to the Pew Research Center, approximately 65,000 undocumented immigrants are employed in Wisconsin. Many must drive to work, but do so without proper licensing or insurance, risking fines and potential deportation. This affects crucial industries including dairy and other agriculture, restaurants, manufacturing, and food processing.

The Wisconsin Coalition for Safe Roads advocates legislation to let undocumented immigrants obtain ‘driving cards.’ These cards would:

  • Enable legal driving within Wisconsin
  • Require passing knowledge and driving tests
  • Mandate obtaining auto insurance
  • NOT provide added benefits such as voting rights or the ability to board airplanes

This reform would:

  • Ensure all drivers are properly tested and know traffic laws
  • Increase the number of insured drivers on the road
  • Help businesses maintain stable workforces
  • Reduce risks for immigrant families
  • Lower uninsured motorist insurance premiums for all drivers

Impact and Benefits

The proposed change would positively affect multiple sectors, including dairy and other agriculture, restaurants, manufacturing, and food processing:

  • Businesses would maintain a more stable workforce
  • Insurance companies would gain new customers
  • State revenue would increase through license fees
  • Law enforcement expenses would decrease

No negative impacts have been identified. States that have implemented similar laws have not repealed them. The cards would only be for driving and would not enable:

  • Voting
  • Air travel
  • Access to government buildings
  • Any other benefits beyond legal driving

Implementation

Three steps are necessary:

  1. Approval from the Wisconsin State Assembly
  2. Approval from the State Senate
  3. Governor’s signature

The Coalition is building a grassroots movement that includes:

  • Law enforcement agencies
  • Local government officials
  • Business leaders
  • Religious organizations
  • Civic organizations

The Coalition aims to gather bipartisan legislative support to pass this important reform.

Nineteen states have successfully implemented similar legislation (see map). Their experience shows:

  • Increased state revenue from license fees
  • Decreased law enforcement costs
  • Improved road safety
  • No negative impacts requiring repeal of the law
